How to Fight Deportation or Removal
People placed in removal (also known as 'deportation') proceedings face tremendous fear and uncertainty. Many are terrified of returning to their country of origin because of the reality of violence awaiting them. Many undocumented foreign nationals have lived in the USA for years, with a home, business and/or close family in the USA. We are here to help by providing individualized representation throughout the removal process.
What we do: we counsel an individual concerning their legal options to fight the government’s efforts to remove them from the USA (‘defense to removal‘). Options include, but are not limited to:

-
Asylum: For those who fear serious harm (‘persecution‘) in their country of origin and can prove their eligibility based on specific legal criteria.
-
Protection under the Convention against Torture: For those who fear they will be tortured in their country of origin, including, but not limited to, torture directly by public officials or by private individuals with the tacit agreement of public officials.
-
Cancellation of Removal: available to certain immigrants and non immigrants if they can establish eligibility based on specific legal criteria. A mainstay of this defense includes, but is not limited to, documented proof of extreme and exceptional hardship to a U.S. citizen spouse or minor child.
The above options to fight removal proceedings are non exhaustive examples and do not constitute legal advice. Remember, it is important to consult with a competent immigration attorney concerning your particular situation and to obtain advice on whatever options you may have to fight deportation!
Attorney Lara Wilkinson provides detailed and comprehensive advice on your options when facing removal proceedings, always taking into account each client’s unique situation.
